This RELEASE AND WAIVER OF LIABILITY (this “Release“) is executed as of January 2024 by any individual (referred to as “I” or “me“) in favor of RAHMA CENTER, a non-profit corporation organized and existing under the laws of the State of California, its agents, owners, officers, volunteers, participants, employees, and all other persons or entities acting in capacity on the their behalf (the “Organization“).
I desire to participate and engage in activities organized and sponsored by the Organization (the “Activities“). I understand that the Activities may include, but are not limited to, sports groups, volunteer positions, reading clubs, and other Organization sponsored events.
In exchange for being allowed to participate and engage in the Activities and for other good and valuable consideration, the receipt and sufficiency of which I acknowledge, I hereby freely, voluntarily, and without duress execute this Release and agree to the following terms:
Compliance with Policies. I acknowledge and agree that I have received and read the Organization’s “Code of Conduct” and the Organization’s “Communication Usage Policy”. I agree to comply with the Organization’s Code of Conduct and the Organization’s Communication Usage Policy, and all other applicable policies and procedures, training, and safety rules of the Organization, and will follow the Organization’s instructions in carrying out the Activities.
Assumption of Risk. I am aware and understand that the Activities may be inherently dangerous and may expose me to a variety of foreseen and unforeseen hazards and risks. I acknowledge that I am voluntarily participating in the Activities and have considered those risks. I hereby expressly and specifically agree to assume such risks incidental to my participation and engagement in the Activities which risks may include, among other things, major and/or minor physical injury, including death or disfigurement, harm or loss caused by aggressive play, unsafe play, terrain, facilities, temperature, weather, condition of participants, equipment, vehicular traffic, and actions of other people, including, but not limited to participants, volunteers, spectators, coaches, teachers, or Organization leaders.
Medical Treatment. I hereby give consent and authority to the Organization to obtain medical treatment on my behalf if I am injured or require medical attention during my participation in the Activities. I understand and agree that I am solely responsible for all costs related to such medical treatment, medical transportation, and/or evacuation. I hereby release, forever discharge, and hold harmless the Organization from any claim whatsoever in connection with such treatment or other medical services.
Release and Waiver. I hereby waive, release, covenant not to sue, and forever discharge the Organization, together with any and all related entities, and the Organization’s officers, directors, employees, and volunteers, and any and all Activity sponsors or charities, and each of their parent, related and affiliated companies, and the officers, directors, employees, agents, Board of Supervisors, representatives, successors, and assigned of each of the foregoing entities (“Released Parties“), of and from any and all liability, claims, actions, damages, costs expenses or demands of whatever kind or nature, either in law or in equity, that may arise from my participation in the Activities. I agree not to make or bring any such claim or demand against the Released Parties, and fully and forever release and discharge the Released Parties from liability under such claims or demands.
I UNDERSTAND THAT THIS RELEASE DISCHARGES THE RELEASED PARTIES FROM ANY LIABILITY OR CLAIM THAT I MAY HAVE AGAINST THE RELEASED PARTIES WITH RESPECT TO ANY BODILY INJURY, PERSONAL INJURY, ILLNESS, DEATH, PROPERTY DAMAGE, OR PROPERTY LOSS THAT MAY RESULT FROM THE ACTIVITIES, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES OR OTHERWISE.
Insurance. I UNDERSTAND THAT THE ORGANIZATION DOES NOT ASSUME ANY RESPONSIBILITY FOR OR OBLIGATION TO PROVIDE FINANCIAL ASSISTANCE OR OTHER ASSISTANCE, INCLUDING BUT NOT LIMITED TO MEDICAL, HEALTH, OR DISABILITY INSURANCE OF ANY NATURE IN THE EVENT OF MY INJURY, ILLNESS, OR DEATH, OR DAMAGE TO OR LOSS OF MY PROPERTY.
I expressly waive any claim for compensation or liability on the part of the Organization in the event of any injury or medical expense.
Indemnification. I hereby agree to indemnify and hold each of the Released Parties harmless against any and all such liabilities, claims, actions, damages, costs, or expenses, including, but not limited to, all attorney’s fees and disbursements up through and including any appeal. I understand that this Release includes any claims based on the negligence, carelessness, action or inaction, of any of the above Released Parties, and from dangerous and defective equipment or property owned, maintain or controlled by Released Parties and covers bodily injury, including death, property damage and loss by theft or otherwise whether suffered by me before or after such participation.
Photographic Release. I understand and agree that during the Activities, I may be photographed and/or videotaped by the Organization for internal and/or promotional use. I hereby grant and convey to the Organization all right, title, and interest, including but not limited to, any royalties, proceeds, or other benefits, in any and all such photographs or recordings, and consent to the Organization’s use of my name, image, likeness, and voice in perpetuity, in any medium or format, for any publicity without further compensation or permission.
Miscellaneous. I hereby agree that this Release constitutes the sole and entire agreement of the Organization and me with respect to the subject matter contained herein and supersedes all other prior agreements, understandings, representations, and warranties, both written and oral, between us, with respect to the subject matter hereof. If any term or provision of this Release shall be held to be invalid by any court of competent jurisdiction, that term or provision shall be deemed modified so as to be valid and enforceable to the full extent permitted. The invalidity of any such term or provision shall not otherwise affect the validity or enforceability of the remaining terms and provisions. This Release is binding on and inures to the benefit of the Organization and me and our respective heirs, executors, administrators, legal representatives, successors, and permitted assigns. Section headings are for convenience of reference only and shall not define, modify, expand, or limit any of the terms of this Release.
Governing Law. I hereby agree that this Release is intended to be as broad and inclusive as permitted, and that this Release shall be governed by and interpreted in accordance with the laws of the State of California, without reference to any choice of law doctrine. Any legal action relating to or arising out of the Release shall be commenced exclusively in the Orange County Superior Court, California (or if such Court shall not have jurisdiction over the subject matter thereof, then to such other court sitting in said county and having subject matter jurisdiction), and I specifically waive the right to trial by jury.
BY REMAINING IN ANY VIRTUAL OR ACTUAL SPACES RELATED TO THE ORGANIZATION, I ACKNOWLEDGE THAT I HAVE READ AND FULLY UNDERSTOOD ALL OF THE TERMS OF THIS RELEASE AND THAT I AM VOLUNTARILY GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE THE ORGANIZATION AND RELEASED PARTIES, INCLUDING THE RIGHT TO SUE THE ORGANIZATION AND RELEASED PARTIES, WITHOUT ANY INDUCEMENT, ASSURANCE, OR GUARANTEE BEING MADE TO ME. I COMPLETELY AND UNCONDITIONALLY RELEASE ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.
The above applies to any minors for whom I am the parent or legal guardian of and engage in the manners descripted above. I have the legal right to consent to and, by allowing their participation, I hereby consent and agree to the terms and conditions of this Release.
Rahma Center Code of Conduct
This Rahma Center Code of Conduct is designed to uphold the unifying, educational, religious, and humanitarian values of our programs and activities. It aims to prevent any methods or practices that might jeopardize the safety, enjoyment, or integrity of our activities. This Code applies to all members of the Rahma Center community. Failure to adhere to this Code may result in disciplinary action, including expulsion from the Rahma Center membership program.
1. Safety and Good Health: Members will take no actions that risk the safety of themselves or any participant, coach, official, or spectator. This includes, but is not limited to, avoiding drugs or doping, unsafe practices, ignoring medical advice, or engaging in reckless behavior.
2. Respect and Dignity: Members are expected to display good conduct in all activities and lifestyle. The Rahma Center community must strive to respect and protect the personal dignity, privacy, and rights of all participants. Hazing, fighting, physical violence, verbal ridicule, and intolerance of differences are not accepted or condoned.
3. Compliance with Laws, Rules, and Regulations: Members must comply with all applicable laws and adhere to internal rules and regulations for participation and safety. Members may not be connected to any form of manipulation or unlawful influencing of results. Rahma Center rejects all forms of bribery and corruption.
4. Social and Environmental Responsibility: Members are expected to behave in a manner that is environmentally and socially responsible. This includes showing respect for the community, participants, coaches, spectators, equipment, and the environment. Appropriate expressions without vulgar, derogatory, or profane language and maintaining positive communications are expected.
By participating in this community, you commit to comply with the Rahma Center Code of Conduct and will work to develop yourself and your community in the spirit and intent of the four core principles as you participate, practice, encourage, and develop in all activities.
Communication Usage Policy
Rahma Center communicates primarily through WhatsApp. By participating in any Rahma Center WhatsApp communities, you agree to the following terms:
1. Privacy of Information: All contact information, including phone numbers, emails, photos, and other social media handles, must be kept private and are NOT to be shared outside of the group.
2. Relevant Communications: This group is for communication regarding official Rahma Center events only. Please do not share external topics, events, or advertisements.
3. Respecting Privacy: The privacy of all group members must be respected. No solicitation of any kind is permitted.
4. Personal Information: By using this platform, you understand that some personal information, such as your profile photo and/or phone number, will be accessible to others.
5. Appropriate Use: Do not use the platform for personal posts or advertisements unrelated to Rahma Center’s business.
6. Group Chats: In group chats, remember that other members can see your information, messages, and media. Only join and share information in groups you trust.
Violation of any of these policies may result in immediate removal from the WhatsApp group. We take the safety and security of our members very seriously and ask that you do the same.
By participating in/remaining in any Rahma Center activities or WhatsApp community, you acknowledge and agree to the above terms.
